Pursuant to a plea agreement, appellant John Lower pleaded guilty to a single count of delivery of a controlled substance, in violation of W.S. 35-7-1031(a)(ii) and 35-7-1014(d)(xiii). Although the trial court initially suspended execution of a one to three year sentence and placed appellant on probation, the original sentence was soon reinstated following revocation proceedings. Lower now appeals, alleging he was deprived of the effective assistance of counsel during the plea bargaining process and his arraignment, and during the subsequent probation revocation hearing. In addition, he asserts that the trial courts failure to credit the reinstated sentence with the time successfully served on probation - Page 348 deprived him of due process and the equal protection of the law.
