These consolidated appeals arise out of the granting of a preference right to Loyd Messerli by the Commissioner of the Alaska Department of Natural Resources (DNR). Messerli filed two lawsuits in connection with the preference right. In the first appeal, Messerli challenges a decision of Judge John Bosshard III finding no procedural irregularities in the DNRs granting of his preference right. The state appeals Judge Bosshards finding of estoppel against it and his decision to award attorneys fees to Mr. Messerli. In the second appeal, Messerli challenges the decision of Judge Milton M. Souter denying him a preliminary injunction.
