FIELD, Chief Justice. This is a petition for a writ of mandamus, brought October 7, 1937, to compel the respondent, the present incumbent of the office of commissioner of agriculture, to restore the petitioner to his former position as assistant director of the division of plant pest control in the department of agriculture without loss of compensation. It was heard by a single Justice of this court, who, at the request of the parties, reported the case, without decision, upon the petition and amended answer, for the determination of the full court. See G.L.(Ter.Ed.) c. 211, § 6; c. 231, § 111; Campbell v. Justices of Superior Court, 187 Mass. 509, 510, 73 N.E. 659, 69 L.R.A. 311, 2 Ann.Cas. 462. On a report in this form no exercise of discretion is involved. The question for determination is whether the writ ought to issue as matter of law. Cochran v. Roemer, 287 Mass. 500, 502, 192 N.E. 58.
